In a Saudi courtroom, the translation is the case. A foreign document is, for evidentiary purposes, the Arabic version. If the Arabic version is inaccurate, incomplete, or stylistically inconsistent with Saudi legal usage, the document is effectively lost — and the case may be lost with it. في قاعة المحكمة السعودية، الترجمة هي القضية. الوثيقة الأجنبية، لأغراض إثباتية، هي النسخة العربية. إذا كانت النسخة غير دقيقة، أو ناقصة، أو غير متسقة أسلوبياً مع الاستخدام القانوني السعودي، فالوثيقة ضائعة فعلياً — وقد تضيع القضية معها.

1. The unregistered translation1. الترجمة غير المسجلة
A foreign arbitral award was filed for enforcement with a translation that omitted the operative paragraphs. The court refused enforcement on the ground that the award was unintelligible in Arabic. The error took six months and a fresh translation to correct. رُفع قرار تحكيم أجنبي للتنفيذ بترجمة حذفت الفقرات الإجرائية. رفضت المحكمة التنفيذ على أساس أن القرار غير مفهوم بالعربية. استغرق الخطأ ستة أشهر وترجمة جديدة لتصحيحه.
2. The "literal" translation2. الترجمة "الحرفية"
An English contract was submitted with a literal Arabic translation that translated legal terms word-for-word. Result: the Arabic version contained terms that have no doctrinal meaning in Saudi law, and the court struggled to interpret the parties' obligations. A qualified translator would have used the equivalent Saudi legal terminology. قُدم عقد إنجليزي بترجمة عربية حرفية تُترجم المصطلحات القانونية كلمة بكلمة. النتيجة: احتوت النسخة العربية على مصطلحات لا تحمل معنى فقهياً في النظام السعودي، وكافحت المحكمة لتفسير التزامات الطرفين. كان المترجم المؤهل سيستخدم المصطلح القانوني السعودي المكافئ.
3. The mismatched pair3. الزوج غير المتطابق
A bilingual contract was signed with the Arabic version containing a clause not present in the English. The English version was held to be the operative text under the parties' choice-of-language clause. The Arabic clause vanished. The lesson: when bilingual contracts are not parallel-reviewed, surprises are inevitable. وُقع عقد ثنائي اللغة وكانت النسخة العربية تتضمن بنداً غير موجود في الإنجليزية. اعتُبرت الإنجليزية النص المعمل به بموجب بند اختيار اللغة. اختفى البند العربي. الدرس: حين لا تُراجع العقود ثنائية اللغة بالتوازي، المفاجآت حتمية.

A certified legal translation in Saudi practice is a translation issued by a translator accredited by the Ministry of Justice, with a signed declaration of accuracy and a statement of the translator's qualifications. For court submission, it must be filed through the court-appointed translation office; the translation is then reviewed and may be revised by the court translator. الترجمة القانونية المعتمدة في الممارسة السعودية هي ترجمة يصدرها مترجم معتمد من وزارة العدل، مع إقرار موقع بالدقة وبيان مؤهلات المترجم. للتقديم أمام المحكمة، يجب أن تُرفع عبر مكتب الترجمة المعتمد لدى المحكمة؛ ثم تُراجع الترجمة وقد ينقحها مترجم المحكمة.
